The Ownership System — Digital Product (eBook Download)

PART I — TERMS AND CONDITIONS

1. General Information

These Terms and Conditions ("Terms") govern the purchase and download of digital products (eBooks and related materials) offered through The Ownership System ("Store"). By completing a purchase, you ("Customer") agree to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must not proceed with a purchase.

2. Products and Digital Delivery

All products sold through The Ownership System are digital goods in the form of downloadable files (e.g., PDF eBooks, audio files, HTML worksheets). No physical goods are shipped.

Upon successful payment, you will receive:

•       Immediate access to a secure download link on the confirmation page, and/or

•       An automated confirmation email containing your download link(s).

Download links may expire after a defined period or number of uses. It is your responsibility to save the downloaded file(s) to a secure location promptly after purchase.

3. Pricing and Payment

All prices are displayed in the currency shown at checkout and are inclusive of any applicable taxes unless stated otherwise.

Payment is processed securely through our third-party payment provider(s) (e.g., Stripe, PayPal). We do not store your payment card details on our servers.

Your purchase is complete once payment is confirmed. You will receive an order confirmation by email.

4. Order Bumps and Additional Products

During checkout, you may be offered additional digital products ("Order Bumps") such as audio versions of the eBook or supplementary worksheet files. These are optional add-ons. By selecting an Order Bump, you agree to purchase the additional product(s) at the stated price, subject to these Terms.

5. Right of Withdrawal and Refund Policy

5.1 Waiver of Right of Withdrawal

Under EU consumer protection law (Directive 2011/83/EU), consumers generally have a 14-day right of withdrawal for distance purchases. However, this right does not apply to digital content that is not supplied on a tangible medium, where fulfilment has begun with the consumer’s prior express consent and acknowledgment that they thereby lose their right of withdrawal.

By completing your purchase and clicking the download link (or by checking the corresponding box at checkout), you expressly consent to the immediate delivery of the digital content and acknowledge that you lose your right of withdrawal upon download commencement.

5.2 Refund Policy

Due to the nature of digital goods, all sales are final and non-refundable once the download has been initiated. If you experience a technical issue that prevents you from accessing your purchase, please contact us within 7 days at mail@ownership-system.com and we will do our best to resolve the issue.

6. Intellectual Property and License

All content contained within the purchased digital product(s) is protected by copyright. Upon purchase, you are granted a personal, non-exclusive, non-transferable license to:

•       Download and store one (1) copy of the product for your own personal use.

•       Read, listen to, or use the content for your own private, non-commercial purposes.

You are expressly prohibited from:

•       Reproducing, distributing, reselling, or sub-licensing the product.

•       Sharing download links with third parties.

•       Uploading the product to any platform or file-sharing service.

•       Creating derivative works without prior written consent.

7. Disclaimer of Warranties

The digital products are provided "as is." The Ownership System makes no warranties regarding the accuracy, completeness, or fitness for a particular purpose of the content. The information provided is for informational purposes only and does not constitute professional, legal, or financial advice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, millautz consulting solutions e.U. shall not be liable for any indirect, incidental, or consequential damages arising from your use of our digital products. Our total liability shall not exceed the amount paid by you for the relevant product.

9. Governing Law and Dispute Resolution

These Terms are governed by Austrian law. In the event of a dispute, we encourage you to contact us first. You may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

Any unresolved disputes shall be subject to the exclusive jurisdiction of the competent courts of Graz, Austria.

10. Changes to These Terms

We reserve the right to update these Terms at any time. The version applicable to your purchase is the one in effect at the date of your transaction.

PART II — PRIVACY POLICY

This Privacy Policy explains how millautz consulting solutions e.U., operating under the brand The Ownership System, collects, uses, stores, and protects your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Austrian Data Protection Act (DSG).

12. What Personal Data We Collect

When you make a purchase, we collect:

•       First name and last name

•       Email address

•       Country of residence (for tax purposes)

•       Payment information (processed exclusively by our payment processor; we do not store card data)

•       IP address and browser/device information (for fraud prevention)

13. Purposes and Legal Bases for Processing

13.1 Order Fulfilment

We process your name, email address, and order details to fulfil your purchase and deliver your digital product. Legal basis: Art. 6(1)(b) GDPR — performance of a contract.

13.2 Email Marketing and Information

After confirming your purchase, your email address will be used to send you product updates, related offers, and promotional communications from The Ownership System.

Legal basis: Art. 6(1)(a) GDPR — your explicit consent given at the time of purchase, or Art. 6(1)(f) GDPR — our legitimate interest in marketing similar products to existing customers.

You may unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link in any email or by contacting us at mail@ownership-system.com. Unsubscribing will not affect delivery of your purchased product.

13.3 Legal Compliance

We retain transaction records to comply with Austrian tax and accounting obligations (7 years). Legal basis: Art. 6(1)(c) GDPR.

13.4 Fraud Prevention

We process technical data to detect and prevent fraudulent transactions. Legal basis: Art. 6(1)(f) GDPR.

14. Data Sharing and Third Parties

We may share your data with:

•       Payment processors (e.g., Stripe, PayPal) for transaction processing.

•       Email service providers (e.g., Systeme.io, Zoho Mail) for transactional and marketing communications.

•       Cloud hosting and delivery platforms for digital product storage and delivery.

All processors are bound by data processing agreements. We do not sell or rent your personal data to third parties.

15. International Data Transfers

Some service providers may be located outside the EEA. Where such transfers occur, we ensure appropriate safeguards are in place (e.g., Standard Contractual Clauses per Art. 46 GDPR).

16. Data Retention

•       Order and transaction data: 7 years (Austrian tax law).

•       Email marketing list: until you unsubscribe or request deletion.

•       Technical/log data: up to 90 days.

17. Your Rights Under GDPR

You have the following rights under GDPR:

•       Right of access (Art. 15)

•       Right to rectification (Art. 16)

•       Right to erasure (Art. 17)

•       Right to restriction of processing (Art. 18)

•       Right to data portability (Art. 20)

•       Right to object (Art. 21), including to direct marketing

•       Right to withdraw consent at any time (Art. 7(3))

18. Cookies and Tracking

Our checkout and delivery pages use essential cookies to enable the purchase process and prevent fraud. Non-essential cookies are only used with your prior consent.

19. Data Security

20. Changes to This Privacy Policy
